Hands Free Tennessee ProgramTo make sure every driver stays alert and focused, the Tennessee Department of Transportation, Department of Tourist Development, and Department of Safety and Homeland Security have come together to create Hands Free Tennessee.

This policy, which was launched into law in the summer of 2019 as Public Chapter No. 412, makes it illegal to use a cellphone or any other mobile devices while you’re operating a moving vehicle.

How Serious Is Distracted Driving?

Over 24,600 accidents in 2018 were caused by drivers who were looking at their phones behind the wheel. With that in mind, it comes out to an average of 67 collisions every day that could have easily been prevented. Those are the national numbers, though, so what about here at home? A recent study found that Tennessee ranks first in the country with more deaths caused by distracted driving than any other state.

What’s Illegal Under the Hands-Free Law?

While you’ll be able to use your cellphone in the event of an emergency, operating a phone or mobile device in normal circumstances can result in up to three points on your license and a fine of up to $200. The following actions are all illegal while you’re driving:

  • Using any part of your body to hold a cellphone or mobile device
  • Reading, writing, or sending any text messages, emails, direct messages, or social media posts
  • Reaching for a cellphone or mobile device in a way that requires you to unbuckle your seat belt
  • Watching a video on your cellphone or mobile device
  • Filming, recording, or broadcasting live video with your cellphone or mobile device
